The Flowers Point Giveaway / Sweepstakes
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
1. Sponsor and Administrator
Sponsor. This sweepstakes (the “Sweepstakes”) is sponsored by The Flowers Point Corp., a Florida corporation, having its principal place of business at 7255 N.W. 12th Street, Miami, Florida 33126.
Administrator. The Sweepstakes is administered by Financial Legal Group, Inc., 2655 Le Jeune Road, 5th floor, Coral Gables, Florida 33134 (the “Administrator”), which will conduct the drawing, verify eligibility, and certify the result. The Administrator is an independent entity retained by Sponsor; no owner, officer, director, or employee of Sponsor holds any ownership or management interest in the Administrator, and the Administrator has no financial interest in the outcome of the drawing. Personnel of the Administrator are ineligible to enter or win. See Section 2.
2. Eligibility
Open only to natural persons who, at the time of entry, are (a) at least eighteen (18) years of age; and (b) legal residents of the United States and of the State of Florida. Void outside the State of Florida and where prohibited or restricted by law.
Not eligible: officers, directors, members, employees, and independent contractors of Sponsor and of the Administrator, and of their respective parent, affiliated, and subsidiary companies, service providers, and business partners; and the immediate family members (spouse, parent, child, sibling, and their spouses) and persons residing in the same household of each such person, whether or not related.
3. Sweepstakes Period and Key Dates
Sweepstakes Period. The Sweepstakes begins at 12:00:01 a.m. Eastern Time on August 19, 2026, and ends at 11:59:59 p.m. Eastern Time on February 22, 2027 (the “Sweepstakes Period”).
Entry deadline — both methods. To be included in the drawing, all entries — purchase-based and free alike — must be received by the Administrator no later than 11:59:59 p.m. Eastern Time on February 22, 2027 (the “Entry Deadline”). The Entry Deadline is identical for both methods of entry. Purchases made, and mail-in entries received, after the Entry Deadline do not generate an entry and will not be included in the drawing. Entrants using the free method should allow ample time for delivery; a postmark on or before February 12, 2027 is recommended.
Drawing. One (1) drawing for all eligible entries will be held on March 1, 2027 at 2:00 p.m. Eastern Time. The Administrator’s records are the official timekeeper for all purposes.
4. How to Enter
4.1 Free Method of Entry (Mail-In / AMOE)
Handprint legibly on a plain three-inch by five-inch (3″ x 5″) card your (i) full name; (ii) complete mailing address; (iii) date of birth; (iv) e-mail address; and (v) telephone number. Mail the completed card, one (1) card per envelope, in a hand-addressed envelope bearing proper first-class postage to:

Mechanically reproduced, photocopied, computer-generated, or automated entries are void. No responsibility is assumed for lost, late, misdirected, illegible, damaged, or postage-due mail. No acknowledgment or return receipt of entries will be provided. Entries become the property of Sponsor and will not be returned.
4.2 Purchase Method of Entry
An entrant who makes a qualifying purchase at Sponsor’s place of business at 7255 N.W. 12th Street, Miami, Florida 33126 during the Sweepstakes Period and on or before the Entry Deadline will receive one (1) entry, generated automatically at the point of sale. A “qualifying purchase” is the purchase of one (1) 100-count rose bouquet at Sponsor’s then-current retail price (currently $136.00). At the point of sale, the entrant must provide the same information required by Section 4.1 — full name, complete mailing address, date of birth, e-mail address, and telephone number — which Sponsor will record and transmit to the Administrator. No mailing and no proof of purchase submission is required under this method.
One entry per qualifying purchase. A purchase of more than one bouquet, or a purchase of a larger or higher-priced bouquet, yields one (1) entry only and does not yield additional entries. All entries under this method remain subject to the daily cap in Section 5.
4.3 Equal-Dignity Statement
Regardless of method of entry, every eligible entry has an equal chance of being selected, the same value, and the same odds of winning. No purchase or payment of any kind is necessary to enter or win, and a purchase will not improve an entrant’s chances of winning. The free method of entry is available on terms co-equal with the purchase method in every material respect, including the same entry deadline, the same maximum number of entries obtainable per day, and inclusion in the same single drawing. Sponsor will not treat purchase-based entries more favorably than free entries in any respect.
5. Entry Limit
Limit: one (1) entry per person per calendar day during the Sweepstakes Period, counting both methods of entry together. An entrant who both makes a qualifying purchase and mails a free-method card on the same calendar day receives one (1) entry for that day, not two. Multiple entrants may not share the same e-mail address, telephone number, or mailing address. Entries generated by script, robot, or other automated means, entries submitted through any entry service, and entries in excess of the stated limit are void.
6. Prizes, Prize Tiers, and Approximate Retail Value
Exactly one (1) prize will be awarded in the single drawing. Which prize is awarded is determined by the total number of eligible entries received during the Sweepstakes Period and on or before the Entry Deadline, as follows:
(a) 25,000 or more entries — Grand Prize: one (1) new 2026 Kia Sportage (ARV $39,450.00), plus a check for Ten Thousand Dollars ($10,000.00) to defray taxes, title, licensing, and registration. Total ARV: $49,450.00.
(b) 18,000 to 24,999 entries — Consolation Prize: a check for Ten Thousand Dollars ($10,000.00). Total ARV: $10,000.00.
(c) 17,999 or fewer entries — Base Prize: one (1) custom 100-stem rose bouquet at the winner’s choosing (ARV $136.00). Total ARV: $136.00.
The tiers are contiguous with no gaps, and a prize is awarded at every entry level, so a prize will be awarded regardless of entry volume. This structure is intended to avoid the “failure to award” and deceptive-advertising exposure under Fla. Stat. § 849.094(2)(c)–(d) and FDUTPA. All advertising must nonetheless disclose the tiered structure with equal prominence to the vehicle, so that no entrant is led to believe the vehicle is guaranteed to be awarded.
Prizes are non-transferable; no substitution or cash equivalent is available except by Sponsor, which may substitute a prize of equal or greater value if the advertised prize becomes unavailable. As to the vehicle, the winner is solely responsible for insurance and all costs not expressly included, must hold a valid Florida driver’s license, and must satisfy all requirements to take title and registration.
7. Odds of Winning
The prize tier that applies depends on the total number of eligible entries received during the Sweepstakes Period and on or before the Entry Deadline. Within the applicable tier, the odds of any individual entry being selected depend on the total number of eligible entries received.
8. Winner Selection and Drawing
The winner will be selected in a single random drawing from among all eligible entries received, conducted by the Administrator using a third-party random-selection program on March 1, 2027 at 2:00 p.m. Eastern Time at Sponsor’s place of business, 7255 N.W. 12th Street, Miami, Florida 33126. Because this is a chance-based sweepstakes, the drawing is by random selection only; no element of skill determines the winner. The Administrator, as an independent party, will conduct and certify the results and will retain the drawing records.
No live broadcast is required and none is a condition of the drawing. Sponsor may, at its option, record or stream the drawing, but no entrant is required to be present, watching, or connected to any broadcast in order to win. There is no “present-to-win” or “must-be-watching” requirement of any kind.
9. Winner Notification, Claim, and Forfeiture
The potential winner will be notified by telephone at the number provided at entry, with attempts commencing promptly after the drawing. Entrants are not required to be present or connected to any broadcast to win.
To claim, the potential winner must, within seventy-two (72) hours after the first documented notification attempt, (i) confirm identity, and (ii) execute and return the required Affidavit of Eligibility, Liability Release, Publicity/Likeness Release, and IRS Form W-9. If the potential winner cannot be reached, fails to respond or return documents, is ineligible, or declines the prize, the prize is forfeited and an alternate may be selected by random drawing from among the remaining eligible entries, time permitting.
10. Conditions of Receiving a Prize; Taxes
All taxes and costs associated with prize acceptance and use not expressly stated as included are the winner’s sole responsibility. Any cash component is itself taxable income. Sponsor will issue an IRS Form 1099 reflecting the total ARV of the prize actually awarded, and the winner must provide a completed IRS Form W-9 as a condition of receiving the prize. The prize will be delivered within ten (10) days after the winner is verified and all required documents are received, to the extent permitted by law.
11. Publicity and Likeness Release (Including AI-Generated Images)
Acceptance of a prize constitutes the winner’s consent, and the winner must separately sign a Publicity/Likeness Release granting Sponsor and its designees the right to use the winner’s name, city of residence, statements, photograph, voice, image, and likeness — including artificial-intelligence-generated or AI-assisted depictions of the winner’s likeness — for advertising, promotional, and publicity purposes, in all media now known or later developed, worldwide, in perpetuity, without further notice, review, approval, or additional compensation, except where prohibited. The scope of AI-generated use is defined in the separate Publicity/Likeness Release and is subject to Fla. Stat. § 540.08.
12. General Conditions; Right to Disqualify
By entering, each entrant agrees to these Official Rules and to the decisions of Sponsor and the Administrator, which are final and binding in all respects. Sponsor may disqualify any entrant who tampers with the entry process or violates these Rules but will not arbitrarily reject any valid entry and will not predetermine, manipulate, or rig the outcome of the drawing.
13. Release and Limitation of Liability
By participating, each entrant releases and holds harmless Sponsor, the Administrator, and their respective officers, directors, employees, and agents from any and all liability for any loss, harm, damage, injury, cost, or expense arising out of participation in the Sweepstakes or the acceptance, use, or misuse of any prize, to the fullest extent permitted by law.
14. Disputes; Governing Law; Venue
These Official Rules are governed by the laws of the State of Florida without regard to conflict-of-laws principles. Any dispute arising out of or relating to the Sweepstakes shall be brought exclusively in the state courts located in Miami-Dade County, Florida, or in the United States District Court for the Southern District of Florida, and each entrant consents to the personal jurisdiction of those courts and waives any objection based on venue or forum non convenience. No arbitration provision applies to this Sweepstakes.
15. Privacy, Data Use, and Communications Consent
Information collected in connection with the Sweepstakes is used to administer the Sweepstakes and as described in Sponsor’s privacy policy, available at https://theflowerspointmiami.com/privacy-policy.
E-mail marketing (opt-in). Entrants may elect, by affirmative opt-in at the time of entry, to receive commercial e-mail from Sponsor. Entry is not conditioned on that election, and declining does not affect an entrant’s odds of winning. All such e-mail will identify Sponsor, include a valid physical postal address, and contain a functioning unsubscribe mechanism honored within ten (10) business days, in conformity with the CAN-SPAM Act, 15 U.S.C. §§ 7701–7713. Entrants may opt out at any time through the link in any message or through the privacy page identified above.
No telephone or text marketing. Telephone numbers collected at entry are used solely to administer the Sweepstakes and to notify a potential winner. Sponsor will not use entrant telephone numbers for telemarketing calls or marketing text messages, and entry does not constitute consent to receive such calls or texts under the Telephone Consumer Protection Act, 47 U.S.C. § 227, or the Florida Telephone Solicitation Act, Fla. Stat. § 501.059.
16. Advertising and Display
The complete advertisement and these Official Rules will be conspicuously displayed at Sponsor’s place of business and on a dedicated “Sweepstakes” page on Sponsor’s website.
Advertising channels. The Sweepstakes will be advertised on Instagram and Facebook only, in addition to display at Sponsor’s place of business and on Sponsor’s website. All paid advertising will be geo-targeted to the State of Florida. Each platform is in no way a sponsor of, endorser of, or associated with the Sweepstakes, and each platform’s own promotion policies apply and control in the event of conflict; entrants release each platform in connection with the Sweepstakes. Sponsor will add no channel not listed in this Section without first confirming that no platform-specific rule is violated.
17. State Filing and Bond
Because the total announced value of the prizes offered exceeds $5,000, this Sweepstakes is registered with the Florida Department of Agriculture and Consumer Services (FDACS) under Fla. Stat. § 849.094, filed not less than seven (7) days before the commencement of the Sweepstakes Period, and a surety bond equal to the total value of all prizes offered has been posted with FDACS through Florida Surety Bonds, Inc. The certified winners list will be filed as required by Fla. Stat. § 849.094(5).
18. Winners List
For the name of the winner (available after the winner is determined), send a self-addressed, stamped envelope to The Flowers Point Sweepstakes, P.O. Box 520567, Miami, Florida 33152, or visit the Sweepstakes page on Sponsor’s website. Sponsor will provide the certified winners list to FDACS under Fla. Stat. § 849.094(5) within sixty (60) days after the winner is determined.
19. Severability; Reservation of Rights
If any provision of these Official Rules is held invalid, the remaining provisions remain in full force and effect. Subject to the rule that filed rules may not be amended after filing, Sponsor may cancel, suspend, or modify the Sweepstakes only if fraud, technical failure, or another factor beyond its reasonable control impairs its integrity, and then only to the extent permitted by law and by FDACS.
